The rent threshold depends on the payment year
Record the payment year before applying a threshold.

The threshold is only one part of the review. The payment path, landlord classification, payment method, and backup-withholding status can change the result.
What counts as rent on Form 1099-MISC
The IRS rent instructions include several common business arrangements:
- Real estate rentals, such as office space
- Machine rentals
- Pasture rentals
- Certain rental assistance payments
- Some leases involving coin-operated amusements or amusement space

Machine rentals with an operator require a split
A machine rental can include both the use of equipment and the operator's services. The IRS instructions direct the payer to prorate the contract:
- The machine-rental portion goes in Box 1 of Form 1099-MISC.
- The operator-service portion goes in Box 1 of Form 1099-NEC.

Rent paid through a property manager follows a separate chain

For a payer-side review, confirm whether the payment goes directly to the property owner or to an agent or manager.
For a property-management client, collect the owner's Form W-9 and review the amounts paid over to each owner under the normal Form 1099-MISC rules.
Landlord tax classification matters
Payments to corporations are generally excluded from Form 1099-MISC reporting, and rent is not listed among the corporate-payment exceptions in the IRS instructions. This generally means rent paid to a C corporation, S corporation, or LLC taxed as either is exempt.
Rent paid directly to an individual, partnership, estate, or LLC not taxed as a corporation generally enters the Form 1099-MISC review when the other requirements are met.
Use the federal tax classification shown on Form W-9. A disregarded single-member LLC follows its owner's classification, while a non-disregarded LLC identifies its classification as C, S, or P. Payment method changes the reporting path
Payments made by credit card, payment card, or certain third-party payment networks are generally reported by the payment settlement entity on Form 1099-K. Backup withholding can require reporting regardless of amount
If federal income tax was withheld under the backup-withholding rules, Form 1099-MISC can be required regardless of the payment amount.
